ORDER : The Court Made the following order :- The petitioner/Accused apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 of I.P.C. in Crime No.215 of 2018, seeks anticipatory bail. 2.
The case of the prosecution is that the defacto complainant is having 20 cows and doing milk vending business and on 09.08.2018 one of his cow was found missing, worth about Rs.30,000/- and in enquiry, he was informed that the petitioner had stolen his cow and sold the same for meat. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case and on suspicious only, the complaint has been given as against the petitioner. 4.The learned Additional Public Prosecutor would submit that the investigation is pending.
https://hcservices.ecourts.gov.in/hcservices/ 4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with
certain conditions. Accordingly, the petitioner shall deposit a sum of Rs.30,000/- to the credit of crime No.215 of 2018 on the file of the respondent police before the learned Judicial Magistrate, Tiruchendur and on such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Thiruchendur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 5..The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
