PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to transfer the investigation in Crime No.102 of 2017 dated 26.04.2017 on the file of the 3rd respondent herein to the 4th respondent herein viz., Inspector of Police, CBCID, Madurai. O R D E R

This Criminal Original Petition has been filed seeking transfer of investigation of the case in Crime No.102 of 2017 from the file of the third respondent to the file of the fourth respondent.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

3.The case of the petitioner is that he was attacked brutally by the accused persons and he suffered with serious injuries and the accused also caused damage to his two wheeler. The incident happened on 20.01.2017. The third respondent registered the FIR only after an order was passed by the learned Judicial Magistrate, Palani under Section 156 (3) Cr.P.C. 4.The learned counsel for the petitioner would submit that the third respondent is not taking any action on the FIR registered in Crime No.102 of 2017 and the petitioner has no confidence in the investigation done by the third respondent. 5.In view of the facts and circumstances of the case, the Superintendent of police, Dindigul District is directed to supervise the Investigation, to be done by the third respondent.

The third respondent is directed to conduct the investigation and file a final report as expeditiously as possible. The first respondent is directed to effectively supervise the third respondent and ensure that the investigation by the third respondent is carried out in a just and proper manner. 6.With the above direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is also closed.
