Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to forbear the 3rd respondent herein from evicting the petitioner trust from the property comprised in T.S.No. 853/3, situated at Idayapottal Street, Srivilliputhur Village and Town, Virudhunagar District, without following due process of law and also without following the procedure adumbrated under section 78 of the HR and CE Act by considering the petitioner's representation dated 12.05.2025. Heard both sides.

2. The petitioner claims right over the land in question. The third respondent temple asserts that it is theirs. The fourth respondent claims to be in possession of the petition mentioned land in his capacity as lessee of the third respondent temple.

3. The relief is sought not against the State or its state instrumentality but against the temple. The petitioner can very well go before the jurisdictional civil Court to establish their claim. Granting such liberty, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
