ORDER
This application has been filed to vacate the interim direction granted by this court in W.M.P(MD)No.8870 of 2025 in W.P(MD)No.12045 of 2025, dated 25.04.2025. 1/3

The learned counsel for the petitioner in the present miscellaneous petition (first respondent in the writ petition) would submit that the third respondent/second respondent has admitted the respondents 1 and 2/petitioners contrary to the norms, and therefore, the interim order passed by this court on 25.04.2025 permitting the respondents 1 and 2/petitioners to write the examinations on 3rd and 4th June 2025 for B.Sc. (Nursing) has to be vacated.
3. On a further query as to how the University is aggrieved by permitting the respondents 1 and 2/petitioners from writing the examinations.
4. It is the submission of the learned counsel for the petitioner/University that the third respondent College has not complied with the requirements and has been collecting fees and admitting the students beyond the management quota.
5. The matter would require detailed consideration at the time of final disposal of the writ petition. Suffice to state that the respondents 1 and 2/writ petitioners cannot be deprived of their right to write the 1st Semester to be held on 3rd and 4th June 2025 for B.Sc (Nursing) at this stage.
6. Further, under similar circumstances, in W.P.(MD).No.14437 of 2025, this court permitted the petitioner therein to participate in the theory and practical examination of the 1st Semester to be held on 3rd and 4th June of 2025 for B.Sc, (Nursing).

7. In view of the above, this miscellaneous petition to vacate the interim order of this court dated 25.04.2025 is liable to be dismissed. Accordingly, the same is dismissed. Needless to state that the right of the University is preserved.
