ORDER : The Court made the following order :- The petitioner/Accused No.12, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(aa),4(1-A) of Tamil Nadu Prohibition Act, 120B, 34, 468, 471, 473, 484, 486, 487 of IPC and 39, 43, 130(4), 192(1) of Motor Vehicles Act, in Crime No.775 of 2016 on the file of the respondent police, seeks anticipatory bail.
2. The matter is of the year 2016, investigation has not been completed. The petitioner has been arrested and remanded to judicial custody in Crime No.1114 of 2021 for the very same offence, later, he was released on bail. Now, steps have been taken by the Investigating Officer to issue PT warrant to the petitioner, When he was in custody for the above said criminal.
3. Considering the facts and circumstances of the case and also considering the fact that the oldness of the crime, this Court is inclined to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis 1/2

4. Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Alangulam, Tenkasi District, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed sd/- 30/08/2022 / TRUE COPY / 08/09/2022 Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
