Heard Mr.R.Balamuruganantham, learned counsel appearing for the petitioner, Mr.J.Ashok, learned Additional Government Pleader appearing for R1 and R2 and Mr.A.Shajahan, learned counsel appearing for R3.

2. The petitioner has filed this petition seeking to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned proceedings of the 3rd respondent in letter Ref.

010600/G/2522/2022 dated 19.12.2022, quash the same and to direct the 3rd respondent to reimburse her medical claim of Rs.1,64,800/-.

3. The petitioner's husband is a retired Headmaster. Her husband has undergone treatment in a private hospital for his illness for which they incurred medical expense of Rs.1,64,800/-. Subsequently, the petitioner's husband died on 07.12.2021. The petitioner claim for reimbursement has been rejected by the third respondent Insurance Company. Hence, the writ petition.

Mr.J.Ashok, learned Additional Government Pleader appearing for the respondents 1 and 2 submitted that the claim of the petitioner was placed before the District Level Empowering Committee meeting held on 08.04.2022 and the District Level Empowering Committee has made a recommendation, on which the third respondent is yet to pass orders.

5. In view of the same, the writ petition is disposed of and the 3/5

third respondent is directed to pass orders in accordance with law on the recommendation of District Level Empowering Committee on the claim of the petitioner within a period of four weeks from the date of receipt of a copy of this order. No costs.
