Prayer: Criminal Original Petition is filed under Section 528 of BNSS Act, praying this Court to direct the District Munsif -cum- Judicial Magistrate Court, Peraiyur to dispose the case in C.C.No.352 of 2022 within the time stipulated by this Court.

ORDER

The present petition has been filed by the defacto complainant in C.C.No.352 of 2022 on the file of the District Munsif -cum- Judicial Magistrate Court, Peraiyur, seeking expeditious disposal of the criminal case.

2. The grievance of the petitioner is that A1 to A4 are police officials and they are not regularly appearing before the Court. Despite issuance of warrant, the police officials are not executing the bailable warrant and therefore, there is a delay in disposal of the criminal case. 2/5

The learned Counsel for State of TN (Crl.Side) appearing for the Inspector of Police, Saptur Police Station, Madurai, submitted that the bailable warrant issued by the Court has been misplaced and in case if a fresh bailable warrant is issued, they will execute it and see that all the four accused are produced before the Court on the next date of hearing.

In view of the above said facts, there shall be a direction to the learned District Munsif -cum- Judicial Magistrate, Peraiyur, to issue a fresh bailable warrant to all the four accused persons on the next date of hearing namely on 25.06.2026 and in case of issuance of such a warrant, the Inspector of Police, Saptur Police Station, Madurai is directed to execute the same and see that the accused persons are secured before the Court on the next date of hearing.

5. With the above said observation, this Criminal Original Petition is disposed of.
