ORDER
Heard both sides.
2.By consent of both sides, the main Writ Petition itself is taken up for final disposal.
3.According to the Petitioner, he made a representation in writing before the second respondent in person on 5.5.2016 praying for 'statement of accounts' being provided to him and that he was ready to pay a sum of Rs.1,50,000/- in respect of his loan amount. Subsequently, on 2.6.2016, he made another representation (postal receipt shows 3.6.2016) addressed to the respondents 1 to 3, whereby and where-under, he had stated that he was not provided with 'statement of accounts' till date and in his account, there are some discrepancies and after rectifying the same, he is ready to pay a sum of Rs.1,50,000/- which may be received and he be relieved from the loan.
4.At this stage, the learned counsel for the respondents 2 and 3 submits that the Petitioner was provided with home loan of Rs.2,50,000/- in the year 2004(on two accounts) and that the said loan expires in the year 2019 and that in the subject-matter in issue, a possession notice was issued and actual possession was taken by the bank. Inasmuch as the Petitioner had failed to pay the loan amount in question and as on 2014, a sum of Rs.4,23,776/- was to be recovered from the Petitioner as an outstanding amount and towards his home loan account. Further, it is also represented on behalf of the respondents 2 and 3 that the Petitioner has not approached the third respondent/bank seeking for a copy of the 'statement of accounts' pertaining to his loan amount.
5.Be that as it may, in view of the fact that the request of the Petitioner is only that he be provided with a copy of the 'statement of accounts', this Court, directs the Petitioner to approach the third respondent/Bank within two days from the date of receipt of a copy of this order. On such approach being made by the Petitioner before the third respondent/Bank, the third respondent/Bank is directed to provide a certified copy of the 'statement of accounts' to the Petitioner(in respect of his home loan account)within two days thereafter.
6.With the aforesaid observations and directions, the Writ Petition stands disposed of. No costs.
