Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents, particularly first respondent to refund the earnest money of Rs.5 Lakhs for purchase of "BIO STIMULANTS" in reference NNO.1737/2025/AM_BS which was paid by the petitioner's company on 11.10.2025 through online payment, by consider the petitioner's representation dated 03.03.2026, 06.04.2026 and 22.04.2026. ORDER

Pursuant to the tender floated by the first respondent inviting bids for the supply of bio-stimulants, the petitioner participated in the tender process by depositing an Earnest Money Deposit (EMD) of Rs. 5,00,000/-. Thereafter, the tender process was not proceeded with on account of a challenge to the tender notification in W.P. No.38287 of 2025 pending before the Principal Bench. Therefore, the petitioner submitted a representation to the first respondent seeking refund of the EMD amount of Rs.5,00,000/-.

2.The learned counsel for the first respondent submitted that the tender process would be proceeded with, subject to the outcome of the writ petition pending before the Principal Bench. 3.The petitioner cannot be made to wait indefinitely for refund of the EMD amount, which is contingent upon the outcome of the said writ petition.

4.In view of the above, the petition is disposed of with a direction to the first respondent to refund the Earnest Money Deposit of Rs.5,00,000/- deposited by the petitioner towards the bid, within a period of six weeks from the date of receipt of a copy of this order. In default, the amount shall carry interest at the rate of 6% per annum from the date of default till the date of actual payment. 5.There shall be no order as to costs.
