BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 06.11.2017 CORAM :

THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN W.P(MD)No.20354 of 2017 C.Neelamegam ... Petitioner Vs.

1. The Revenue Divisional Officer, Dindigul, Dindigul District.

2.M.Eswari 3.M.Rajendran 4.D.Ramaprabha ... Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 1st respondent to correct the Patta Register based on the registered partition deed No.1426/1978 dated 16.09.1978 and based on the enquiry report of the Village Administrative Officer dated 06.01.2017 in the proceeding in the file No.Oo.Mu.No.5839/2014/B4 on the file of the 1st respondent within a time frame fixed that may be fixed by this Court.

For Petitioners : Mr.V.Angusamy

O R D E R

The petitioner is aggrieved by issuance of patta granted on account of mistake that took place during UDR. To correct any UDR mistake, the aggrieved party must move the District Revenue Officer. In this case, the writ petitioner appears to have moved the Revenue Divisional Officer. It is not correct. 2.When the writ petition came up for hearing, the learned counsel appearing for the writ petitioner sought permission of this Court to withdraw the writ petition with liberty to move the appropriate authority. He has also made an endorsement to that effect.

3.This writ petition is dismissed as withdrawn with liberty. No costs.
