O R D E R

The petitioner challenges the order dated 16.10.2017, issued by the second respondent declining permission for conducting the cultural programme on 09.11.2017 in connection with temple festival of Arulmighu Sri Muthalamman, Sri Manthaiamman Thirukovil at https://hcservices.ecourts.gov.in/hcservices/ Kullappagoundan Patti, Uthamapalyam Taluk, Theni District.

It is not the case of the respondent holding of the said programme has raised any law and order problem in the previous years. I am therefore of the view that the permission can be granted to the petitioner. Therefore, the impugned order dated 16.10.2017 passed by the second respondent is set aside and the respondents are directed to permit the petitioner to conduct the cultural programme on 09.11.2017 between 06.00 pm and 10.30 pm. It is always open to the respondent police to impose such conditions as deemed fit for ensuring the smooth conduct of the festival. If any of such conditions are violated, the respondent police may interfere and stop the programme. This petition is allowed accordingly. No costs.
