Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records of the second respondent pertaining to the impugned proceedings No.SO (V & DP)/1366/2018, dated 22.08.2018 and quash the same as illegal and arbitrary and consequently direct the respondents to allow the petitioner to continue the service in the third respondent's College within the time that may be stipulated by this Court.

O R D E R

The petitioner has come forward to file the writ petition challenging the impugned order of suspension, dated 22.08.2018.

2. The petitioner has been suspended from service by communication dated 22.08.2018, on the ground that he has misbehaved with one M.A.Girija and the entire issue was broadcasted and telecasted. The contention of the petitioner is that he should have been put on notice before issuance of suspension order. https://hcservices.ecourts.gov.in/hcservices/

3. After arguing the matter elaborately, the learned counsel appearing for the petitioner sought permission of this Court to withdraw the writ petition and this Court having spent time in hearing the matter, did not permit the petitioner to withdraw the writ petition.

4. The contention of the petitioner cannot be accepted and the suspension is not a punishment. If the petitioner is able to succeed in the proceedings, it is for the Department to decide as to how the suspension period should be treated. Hence, this Court is not inclined to grant the relief sought for by the petitioner. Accordingly, the writ petition is dismissed. The respondents shall commence the enquiry and proceed with the same on day-to-day basis without adjourning the matter beyond seven working days at any point of time. No costs. Consequently, the connected Miscellaneous Petition is closed.
