Cr.No.286/2022. ... Respondent For Petitioner : Mr.B.Micheal Sebastin, Advocate. For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.286/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner is facing charges under Section 379 IPC in Crime No.286 of 2022 on the file of the respondent police. 2.This is the second anticipatory bail application that was moved by this petitioner. When the earlier anticipatory bail application was moved, it was submitted before the Court that only the locket of the chain was handed over by the petitioner and regarding the chain, there was no information by the petitioner. So, on that ground, the earlier petition was dismissed. 3.Now, the learned counsel for the petitioner submits that the petitioner is ready to deposit the value of the alleged missing chain.

4.In view of the submission made by the learned counsel for the petitioner, this Court is inclined to grant anticipatory bail to the petitioner.

5.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.12804 of 2022 arrest or on his appearance, before the learned Judicial Magistrate, Eraniel, Kanyakumari District, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned. The petitioner shall deposit a sum of Rs.50,000/- to the credit of Crime No.286 of 2022 before the concerned Court. The petitioner shall also appear before the respondent police daily at 10.30 a.m. until further orders and shall cooperate with him to complete the process of investigation. The amount must be deposited on or before 03.08.2022. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
