ORDER
The Writ Petition is filed seeking issue of Writ of Mandamus, directing the third respondent herein to implement the order passed by the second respondent in his proceedings in Na.Ka.No.5678/2023/A1, dated 14.05.2024 and issue patta in the name of the petitioner for Natham lands comprised in S.No.913/25, measuring an extent of 0.00.52 sq.mt., situated at Balakrishnapuram Village, Dindigul East Taluk, Dindigul District.
2.Heard the arguments of the learned counsel for the petitioner, Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents. By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself. 3.It is seen from the affidavit and the typed set of papers that the petitioner belongs to Puthirai Vannan Community, which is classified as a Scheduled Caste. The petitioner has been in possession and enjoyment of the subject property for more than 20 years. On the strength of his 2/5
long possession, he submitted an application before the Tahsildar, seeking issuance of patta and the same was rejected. 4.Aggrieved by the rejection order, the petitioner filed an appeal before the second respondent and the same was allowed by the second respondent in the proceedings mentioned above, dated 14.05.2024. The second respondent directed the third respondent to issue patta in favour of the petitioner in respect of the subject property. Even thereafter, the third respondent has not implemented the order passed by the second respondent. Therefore, the petitioner is constrained to file the present Writ Petition.
5.The learned Government Advocate, who takes notice for the respondents, would summit that the order passed by second respondent will be implemented within a period of four weeks from today. 6.The statement made by the learned Government Advocate is recorded and the third respondent is directed to implement the order passed by the second respondent in his proceedings in Na.Ka.No. 5678/2023/A1, dated 14.05.2024 and mutate the revenue records accordingly within a period of four weeks from today. 3/5
7.With the aforesaid directions, this Writ Petition stands disposed of. No costs.
