ORDER : The Court made the following order :- The petitioner / accused was arrested and remanded to judicial custody on 27.04.2025, for the alleged offences punishable under Sections 296(b), 118(1), 109(1) and 351(3) of BNS, 2023 @ 296(b), 103(1) and 351(3) of BNS, 2023 on the file of the 1/3

respondent-police seeks bail.

2. The case of the prosecution is that due to money dispute between the deceased and the petitioner / accused, on 27.04.2025, the petitioner herein indiscriminately attacked the deceased with Aruval and thereby, caused injuries on his vital parts of the body and that the deceased was died while he was taking treatment in the hospital. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. He further submits that the petitioner is in judicial custody since 27.04.2025 and hence, he prays to grant bail to this petitioner.

4. The learned Government Advocate (Crl. side) appearing for the respondent-Police, submits that the petitioner was arrested only on 27.04.2025 and the investigation of this case is pending and therefore, at this stage, if the petitioner is released on bail, he may abscond and cause threat to the defacto complainant and other witnesses. Hence, he prays for dismissal of this petition.

5. Heard on both sides and perused the records.

6. Considering the gravity of offence and also considering the fact that the investigation of the case is at the preliminary stage, this Court is not inclined to 2/3

grant bail to the petitioner.
