The petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent ie., Managing Director of TWAD Board, Chennai to pass appropriate orders on the petitioner's representation dated 25.02.2016 regarding payment of interest for the delayed disbursement of G.P.F. ie., from September 2010 to December 2015 within a specified time frame that may be fixed by this Court. Mr.K.Muthuramalingam, learned counsel takes notice for the respondent. By consent of both parties, this Writ petition is taken up for final disposal.

2.Heard both sides.

3.The petitioner namely, Mr.P.Guruva Reddiar, who was serving as Executive Engineer, suffered an order of removal from service as per proceedings No.63433/Estt (DP)/A4/2009, dated 28.05.2010, passed by the Managing Director, TWAD Board, Chennai. As against the said order, an appeal was filed by the petitioner, which was also dismissed, confirming the order of dismissal. 4.Challenging the said order of dismissal, the petitioner had filed a Writ petition in W.P.(MD)No.13173 of 2011, and this Court, by orders dated 01.07.2014, had set aside the order of dismissal and remanded the matter back to the respondent / Board for passing a speaking order, after providing an opportunity of https://hcservices.ecourts.gov.in/hcservices/

hearing to the petitioner. Once again the respondent passed the order of dismissal on 01.10.2014 and challenging the same, the petitioner had filed a Writ petition in W.P.(MD)No.2554 of 2015, and the same is pending.

5.In the meantime, on 31.05.2010, the petitioner had attained the age of superannuation. Since the respondent has not settled the retirement benefits to the petitioner, he had filed a Writ petition in W.P.(MD)No.2305 of 2015, seeking a direction to the respondent to consider his representation, dated 21.07.2010, for disbursement of GPF amount. This Court, by order dated 23.02.2015, directed the respondent to consider the representation of the petitioner and pass orders, within a period of two weeks from the date of receipt of a copy of the order. Accordingly, the respondent, by orders dated 23.12.2015, settled the GPF amount with interest upto August 2010.

6.Now, the grievance of the petitioner is that he is entitled to get interest from September 2010 to December 2015, and he made a representation, dated 25.02.2016, to the respondent, seeking interest for the belated disbursement of G.P.F. amount for the abovesaid period, but, the same has not been considered by the respondent so far, hence, he has come to this Court with the present Writ petition.

7.Considering the limited prayer sought for by the petitioner, without going into the merits of the matter, the respondent is directed to consider the said representation of the petitioner and pass orders on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.

8.The writ petition is disposed of accordingly. No costs.
