ORDER

Heard both sides.

2.The petitioner is 71 year old citizen. In a partition suit in O.S.No.168 of 1996 on the file of Principal Sub Court, Kumbakonam he was allotted the petition mentioned premises in the final decree. Copy of the final decree has also been enclosed in the typed set of papers. It is stated that the adjacent house was allotted in favour of this brother. So long as his brother was alive, the petitioner was enjoying the common service connection. Now the petitioner's brother is no more, difference of opinion has arisen between the petitioner and his sister-in-law. Therefore, the petitioner wants separate service connection for the petition mentioned house.

3.No exception can be taken to the petitioner's request. The second respondent is directed to process the petition mentioned application and grant service connection to the petitioner as prayed for. This shall be done as expeditiously as possible. 2/4

4.This writ petition is allowed accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 01.08.2024 NCC : Yes / No Index : Yes / No Internet : Yes / No MGA 3/4
