Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS, directing the 1st Respondent Bank to permit the 2nd Petitioner, being the Secretary of the Trust and Correspondent of the SA College, to operate Non-Salary Account in A/c. No. 555544766 and the Secretary S.A. College Account in A/c. No. 555563697, based on the representations dated 22.11.2024 and 03.01.2026.

O R D E R
The petitioners have approached this Court seeking a direction to the first respondent-Bank to permit the second petitioner, who claims to be the Secretary of the Trust and Correspondent of S.A. College, to operate the Non-Salary Account bearing No.555544766 and the Secretary, S.A. College Account bearing No.555563697, based on the representations dated 22.11.2024 and 03.01.2026. 2/6
2. The second petitioner claims to be the duly appointed Secretary of the Trust and has produced a copy of the Trust Deed in support of his claim. According to the petitioners, a representation was submitted to the first respondent-Bank seeking permission for the second petitioner to operate the aforesaid accounts. However, the Bank has not acted upon the request on the ground that the brother of the second petitioner is also claiming to be the Secretary of S.A. College.

The petitioners further rely upon the order passed by this Court in W.P.(MD) Nos.26509 and 26510 of 2024 dated 05.11.2024, wherein the claim of the brother of the second petitioner to the post of Secretary was allegedly negatived. It is, therefore, contended that there is no subsisting dispute regarding the second petitioner's status as Secretary of the Trust and Correspondent of the College and that the Bank is not justified in refusing to permit him to operate the accounts.
4. Per contra, the learned counsel appearing for the first respondent-Bank submitted that the petitioners' request can be considered, provided a fresh representation is submitted along with all 3/6
relevant documents establishing the second petitioner's entitlement to operate the accounts. It was further submitted that the matter would be considered after affording an opportunity to all necessary parties who may have a claim or interest in the subject matter. 5.The said submission is placed on record.
6.In view of the above, this writ petition is disposed of with liberty to the petitioners to submit a fresh representation to the first respondentBank, enclosing all relevant documents in support of their claim. Upon receipt of such representation, the first respondent shall consider the same on its own merits, after affording an opportunity of hearing to all necessary parties, and pass appropriate orders in accordance with law. 7.The aforesaid exercise shall be completed within a period of four
(4) weeks from the date of receipt of the fresh representation and supporting documents from the petitioners.

8. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
