PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the Respondent No. 1 to 4 to implement the order passed by the 1st Respondent in Mu. Mu.No. 662486/2023/C6 dated 03.09.2024 as per the powers vested with him under Section 22 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007 and consequently to direct the 1 to 4 respondents to take necessary steps in directing the specified officer subordinate to attach 5th Respondent salary within a time stipulated by this Court. Heard Mr. A. Sheik Nasurdeen, learned counsel appearing for the petitioner; Mr. M. Mahaboob Athiff, learned Government Advocate, who accepts notice on behalf of respondents 1 to 3; and Mr. R. Mohammed Riyaz, learned Government Advocate (Criminal Side), who accepts notice on behalf of the fourth respondent. Notice to the fifth respondent is dispensed with in view of the order proposed to be passed. 2/6
2.The petitioner is before this Court seeking issuance of a Writ of Mandamus directing respondents 1 to 4 to implement the order passed by the first respondent in Mu.Mu.No.662486/2023/C6 dated 03.09.2024. 3.The records disclose that the first respondent, in exercise of the appellate powers conferred under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, passed an order dated 03.09.2024 directing the fifth respondent to pay a sum of Rs.2,000/- per month towards maintenance to the petitioner, who is the grandmother of the fifth respondent. The grievance of the petitioner is that, despite the passage of considerable time, the said order has not been implemented and no effective steps have been taken for recovery of the maintenance amount, including by attachment of the salary of the fifth respondent. 4.Mr. M.
Mahaboob Athiff, learned Government Advocate appearing for respondents 1 to 3, on instructions, submitted that the order passed by the first respondent would be implemented, provided there is no legal impediment, within such time as may be stipulated by this Court. The said submission is placed on record.

5.In view of the above submission, and without expressing any opinion on any factual or legal issues that may arise in the course of implementation, this Court is of the view that the petitioner is entitled to seek enforcement of the order already passed in her favour. 6.Accordingly, the writ petition stands disposed of with a direction to the third respondent to take appropriate steps for implementation of the order passed by the first respondent in Mu.Mu.No.662486/2023/C6 dated 03.09.2024 and to ensure its enforcement in accordance with law, if there is no legal impediment.
7.The aforesaid exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order. 8.There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
