Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent herein to permit the petitioner to lay the pipe line in ground level from the lands comprised in Survey No.429/1 to the land situated in patta No.536, situated in Vellakulam Village, Thiruvengadam Taluk, Tirunelveli District in view of the representation dated 31.10.2017. By consent, the writ petition is taken up for final disposal at the stage of admission itself.

2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondent.

3. The case of the petitioner is that in Survey No.429/1 a well is situated and sufficient water is also available. Hence, she has decided to lay the pipe line through the lands in S.No.429/1 to the land situated in Patta No.536, to over come severe water scarcity.

Therefore, she has submitted a representation dated 03.01.2017, followed by a reminder dated 31.10.2017 and the same have not been considered. Hence, the petitioner is before this Court with the above prayer. https://hcservices.ecourts.gov.in/hcservices/

Considering the facts and circumstance of the case and also taking into account the limited scope of the relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the matters, directs the respondent to consider the representation of the petitioner dated 31.10.2017 and pass suitable orders thereon, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner as well as other interested parties, if any.

5. With the above direction, this petition is disposed of. No costs.
