PRAYER: Criminal Original Petition filed under Section 407 r/w 482 of the Cr.P.C., to grant an order for the withdrawal of the pending M.C.No.24 of 2016 from the Family Court, Madurai may be transferred to the Court having competent jurisdiction over the residence of the petitioner viz., the learned Chief Judicial Magistrate, Madurai within reasonable time that may be fixed by this Court. O R D E R

This Court passed the following order on 29.08.2018. "It is seen from the records that the petitioner along with her minor childrens have filed M.c.No.24 of 2016 seeking for maintenance. The petitioners have also filed petition in Crl.M.P.No.206 of 2016 seeking for interim maintenance. Counter has also been filed in both the main M.C. as well as petition for interim maintenance. However, till date interim maintenance petition has not been heard and any order has been passed. The learned Family Judge, Madurai is directed to file a report in this regard on or before 10.09.2018. Post the matter on 12.09.2018."

2.The Judge of the Family Court, Madurai has sent the report dated 06.09.2018 explaining the reasons as to why the Court was not able to take up the interim maintenance petition for hearing. 3.This Court deems it fit to direct the Family Court, Madurai, to continue to hear the petition filed in M.C.No.24 of 2016.

3.The Judge, Family Court, Madurai is directed to dispose of M.C.No.24 of 2016 within a period of two months from the date of receipt of a copy of this order and report compliance before this Court after completion of the proceedings.

4.With the above direction, this Criminal Original Petition is disposed of.
