PRAYER : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to award work contract to the petitioner for transporting the petroleum products of the respondents through tanker lorries to the petitioner based on the representations dated 06.06.2017 and 11.10.2017.

The petitioner, who is a contractor involved in the business of transporting petroleum products, is before this Court, alleging that the respondents failed to settle his bills and kept his representation, seeking work order in his favour, pending.

2. Notice to the respondents is dispensed with, as no adverse order is going to be passed.

3. According to this Court, the prayer sought for in this writ petition cannot be granted, since, in a strait jacket manner the petitioner seeks work order in his favour for transporting https://hcservices.ecourts.gov.in/hcservices/

petroleum goods. While offering work orders, there is a procedure enacted by the statute, i.e., tenders have to be called for by the authorities and after following due process of law, necessary work orders will be issued.

4. Therefore, this Court is not inclined to entertain this petition and the same is disposed of, leaving it open to the petitioner to participate in the tender, as and when called for by the authorities and if the petitioner is declared successful, it is always open to him to carry out the said business.
