ORDER

This revision case has been filed to direct the learned Chief Judicial Magistrate, Kumbakonam, Thanjavur District to expedite the proceedings pending in Special Case No.57 of 2014 and to dispose of the case.

2.The contention of the petitioner is that the trial Court and the prosecution is not showing any interest in the trial and the matter is pending more than four years without examining any witness. In support of his contention, the docket orders passed by the trial Court is annexed.

3.A perusal of the docket order indicates that the present petitioner, who is A4, is not regular in attending the Court and on more than two occasion, NBW was issued for his non appearance and later he was arrested and also on most of the occasion, though he was not present, the Court has shown indulgence in allowing the petition filed under Section 317 Cr.P.C.

4.It is palpable from the records that the non co-operation of the petitioner herein have caused the delay. Now, he wants to expedite the trial. This Court is not for the convenience of the accused persons, but it can only help to accommodate the persons, who are cooperating for the trial.

5.Hence, this criminal original petition is dismissed. Since the petitioner wants to expedite the trial, the trial Court is directed not to recall the warrant, if the petitioner is not present, secure him and expedite the trial.
