ORDER : The Court Made the following order :- The petitioner is in judicial custody since 12.08.2018 for the offences punishable under Sections 294(b), 506(i) I.P.C. and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act @ into 294 (b), 506(i) and 306 I.P.C. and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act in Crime No.14 of 2018 on the file of the respondent Police. He seeks bail.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) for the respondent. 3.The case of the prosecution is that the deceased girl is studying second year B.E. in Sarathan College, Trichy. She got acquaintance with the petitioner through chatting in internet. They fell in love with each other for the past two years. But she refused to marry the petitioner. Therefore, on 10.08.2018 at about 06.45 p.m. near Ponmalaipatti Panchayat Board, Trichy, the petitioner threatened the victim girl to marry him. Therefore, she committed suicide on 11.08.2018, by way of setting fire by pouring kerosene herself at her residence and she died after five days. https://hcservices.ecourts.gov.in/hcservices/ 4.The learned counsel appearing for the petitioner would submit that the petitioner is studying second year B.E. in Sasthra
University at Kumbakonam. On the date of alleged occurrence, he was in College. No such occurrence was happened as alleged by the prosecution Case.
5.Considering the above facts and circumstances and also considering the period of incarceration undergone by the petitioner from 12.08.2018, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Additional Mahila Court, Trichy.
(ii)the petitioner shall appear before the respondent police every Saturday and Sunday evening at 08.00 p.m. until further orders;
