Mr.M.Shajahan COMMON JUDGMENT (Judgment of the Court was delivered by N.Seshasayee, J.) These appeals are preferred challenging an order dated 18.01.2019 passed by the learned Family Court, Madurai in S.M.O.P.No.1 of 2017 and H.M.O.P.No.576 of 2018.

2. The respondent herein had laid S.M.O.P.No.1 of 2017 for dissolution of marriage and the appellant had laid H.M.O.P.No.576 of 2018 for restitution of conjugal rights. After due enquiry, the learned Family Judge had allowed S.M.O.P.No.1 of 2017 filed by the husband for dissolution of marriage and dismissed H.M.O.P.No.576 of 2018 filed by the wife for restitution of conjugal rights.

3. The learned counsel on either side make a joint statement that parties have taken a decision to abide by the order of the Family Court, Madurai. In view of the same, learned counsel for the appellant submitted, on instructions, that the appellant is not keen to prosecute these appeals. Accordingly, the learned counsel for the appellants withdraws these appeals and has made necessary endorsement.

4. Accordingly, these Civil Miscellaneous Appeals are dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
