Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 herein to grant permission to the petitioner, to remove the banyan tree in the petitioner's patta land in Survey No.1088/112 in Patta No.19227 total extent 2.30 ares (2475 square feet) which is situated at Adiyanuthu Village, Dindigul East Taluk, Dindigul, based on the petitioner's representation dated 24.04.2025 within a stipulated period as prescribed by this Court. 1/4

ORDER

The Writ Petition is not maintainable as against the Chairman, National Green Tribunal. Infact, there is no Chairman at Chennai. As such, the writ petition is struck off as against the second respondent.

2. The grievance of the petitioner is that the petitioner has made an application for permission to cut the banyan tree in his patta land.

3. When the matter came up for admission, the learned Government Advocate, taking notice on behalf of the respondents, would submit that by taking the views of the appropriate tree committee, the first respondent will pass appropriate orders in accordance with law.

4. In view thereof, this Writ Petition is disposed on the following terms: (i) The representation of the petitioner dated 24.04.2025 shall be taken up for consideration;

(ii) Notice of hearing shall be issued to the petitioner and if any authority has to be heard, the same can be heard and orders in accordance with law shall be passed;

(iii) In any event, final orders shall be passed on the representation of the petitioner within a period of four months from the date of receipt of a web copy of the order. (iv) No costs.
