J U D G M E N T

[Judgment of the Court was made by RMT.TEEKAA RAMAN, J.] The unsuccessful writ petitioner is the appellant herein. He filed the writ petition in W.P.(MD) No.8829 of 2020 for a direction to the respondents 1 and 2 to cancel the registration of the eighth respondent Association, for the alleged violation.

2. The learned Single Judge, after hearing both sides, by the impugned order disposed of the writ petition, wherein he has observed as follows:

"4. I am of the view that these contentious issues need not be gone into. I have already held in W.P.(MD)No.6755 of 2020 and batch of cases vide order dated 02.09.2020 that there can be only one umbrella organisation, namely, Water Users Association constituted under Section 4 of Tamil Nadu Act 7 of 2001...

5. In view of the aforesaid Judgment, the Department cannot deal with such privately formed societies. The authority can only deal with the duly formed organisations. Since such Judgment has already been rendered by this Court, the existence of the eighth respondent cannot have any legal

consequence. Of course in the case on hand, Kudimaramath works appear to have been substantially completed and there has also been subsequent disbursement of funds. In the aforesaid Judgment, I had already held that there is no need to interfere with what has already happened. The guidance is only for the future."

3. Challenging the same, the present writ appeal.

4. Learned Additional Government Pleader appearing for the respondents 1 and 2 produced a typed set of papers indicating the fact that based upon the communication received from the sixth respondent, dated 20.05.2020 and also from the authority concerned in the Public Works Department, necessary enquiry has been conducted and and opportunity of being heard was also given to the writ petitioner and also the concerned Panchayat and thereafter, it was found that the representation given by the appellant was bereft of details, besides the allegations made by him found to be not true and therefore, the representation of the appellant has been rejected vide proceedings of the second respondent, dated 09.10.2020 and the same was despatched to the appellant on 10.10.2020.

5. In view of the above subsequent development, we are of the view that nothing survives for adjudication in this writ appeal.

6. Accordingly, this writ appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [T.K.R., J.] [N.S., J.] 20.11.2024 NCC :
