ORDER
The present Writ Petition has been filed for the issuance of a Writ of 1/4
Certiorarified Mandamus, to quash the Impugned Refusal Check Slip dated 28.05.2025 and consequently direct the respondent to register the Sale Deed dated 28.05.2025.
2. The respondent has issued the impugned refusal check slip on the ground that the petitioner seeks to register a larger extent of the property without subdivision and without clearly indicating their entitlement in the suit property. Furthermore, the petitioner has not taken steps to divide the property and obtain a separate Patta, and the Patta currently stands as a Joint Patta.
3. In the counter, it is stated that the property cannot be identified. On verifying the schedule of the property as per the sale deed, it is seen that a portion marked as part of the western corner belongs to the other party and the remaining land belongs to the petitioner. Based on this description, the petitioner is entitled to (*)3 acres 8 cents and the same is identifiable.
4. Accordingly, the impugned Refusal Check Slip dated 28.05.2025 is hereby quashed. The respondent is directed to register the sale deed indicating the property as undivided share within a period of six weeks from the date of receipt of 2/4
a copy of this order.
5. With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
