Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the records of the Impugned Auction Sale Notification of the respondent in Na.Ka.No.D3/COLTNV/34009/2018 dated 21.04.2025 and quash the same as illegal and consequently direct the respondent to not to issue any Sale Certificate in favor of any auction 1/4

purchasers based on the above Auction Sale dated 22.05.2025 and to consider the representation of the petitioner dated 28.11.2022, 21.05.2025 and 22.05.2025.

Heard both sides.

2.The writ petitioner is an accused in a case arising under the TNPID Act. His properties were brought to sale. The respondents 2 and 3 had offered a bid amount of Rs.65 Lakhs in all for Item Nos.4 to 9. The writ petitioner thereupon filed this writ petition submitting that the property had been sold for a lesser value and that he is ready with a purchaser who will offer Rs.85 Lakhs. In fact, the petitioner even produced demand draft for a sum of Rs.82 Lakhs. Thereupon, the auction sale was set aside and a fresh auction was ordered to be held. The upset price was fixed as Rs.1 Crore. Unfortunately, it it did not 2/4

attract any bidder. I am therefore of the view that these items ie., Item Nos.4 to 9 can as well be sold to the purchaser identified by the writ petitioner upon his remitting a sum of Rs.85 Lakhs before the first respondent herein. Direction is accordingly issued. The sum of Rs.50,000/- each deposited by the respondents 2 and 3 will be refunded to them forthwith and without any delay.
