ORDER

The petitioner herein seeks a direction to the respondent to subdivide the property, measuring an extent of 16 cents, comprised in S.No. 80/3 situated at Ayyampalayam Village, Mannachanallur Taluk, Trichy 1/5

District and to issue separate patta in the name of the petitioner and her siblings, by considering her application dated 03.01.2025. 2.Heard the arguments of the learned counsel for the petitioner, Mrs.S.Jeya Priya, learned Government Advocate, who takes notice for the respondent. By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself. 3.It is the case of the petitioner that her father owned 48 cents in the above mentioned survey number having purchased the same in the year 2015. Subsequently, he sold 32 cents in favour of one Ramaiah under a registered sale deed, dated 01.10.2018. Thus, the petitioner's father retained 16 cents. He died on 25.04.2021. Thereafter, the revenue documents got mutated jointly in the names of the petitioner, her siblings and also the purchaser, Ramaiah.

Therefore, the petitioner submitted series of applications before the respondent seeking sub-division of the property and issuance of separate patta in the name of the petitioner and her siblings in respect of 16 cents retained by her father. The last of the application was submitted before the respondent on 03.01.2025. Till date, the same has not been considered. Hence, the petitioner has come before this Court.

4.The learned Government advocate, who takes notice for the respondent, would submit that the application submitted by the petitioner will be considered on its own merits within the time stipulated by this Court.

5.In view of the same, without going to the merits of the claim made by the petitioner, the respondent is directed to consider the application dated 03.01.2025 and pass final orders on its own merits, within a period of 8 weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the other interested parties.

6.With the aforesaid directions, this Writ Petition stands disposed of. No costs.
