The Petitioner herein seeks for a direction to the respondents 1 and 2 to carry out appropriate survey and demarcate the boundaries of the Petitioner's land by fixing survey stones in S.No.4/2A, to an extent of 0.24.00 hectare, S.No. 4/3A1, to an extent of 0.22.00 hecare and S.No.4/4A to an extent of 0.04.00 hectare situated at Chathirapatti Village, Dindigul West Taluk, Dindigul District.
2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.The Petitioner herein claim right over the above said property as per partition, dated 31.3.2017 and the patta for the 2/5
said property stands in the name of the Petitioner in Patta No. 2401. The Petitioner submitted an online application on 2.8.2024 seeking survey of the above mentioned property. He also paid necessary charges for the survey as seen from the acknowledgment enclosed in the typed set of papers. 4.The learned Additional Government Pleader, who takes notice for the respondents 1 and 2 would submit that online application of the Petitioner will be considered on its own merits within the time stipulated by this Court.
5.In view of the same, without going into the merits of the claim made by either side, this Court is inclined to direct the respondents 1 and 2 to consider the online application of the Petitioner, dated 2.8.2024 in Application No.
2024/0123/13/004695 and pass final orders on its own merits after giving notice to the Petitioner and respondents 3 to 5, who are all the neighbouring land owners, within a period of 8 weeks from the date of a copy of this order.
6.With the above direction, the Writ Petition stands disposed of. No costs.
