Respondent For Petitioner : Mr.R.Krishnamurthy For Respondent : Mr.P.Kottaichamy, Government Advocate (Crl.Side) PETITION FOR RELAXATION Under Sec.439(1)(b) r/w 482 of Cr.P.C PRAYER :- For relaxing the condition imposed in Crl.M.P.No.2477 of 2021, dated 20.07.2021 on the file of the Principal Sessions Court, Tiruchirappalli in Crl.MP.No.18 of 2021 dated 07.01.2021 on the file of the Principal Sessions Judge court in Crime No. 18 of 2020 on the file of the Respondent police ORDER : The Court made the following order : The petitioner was arrested for the offence under Sections 420, 406 IPC in connection with the case in Crime No.18 of 2020 on the file of the respondent police and remanded to judicial custody on 17.12.2020.

Subsequently, he was enlarged on bail by the learned Principal Sessions Judge, Tiruchirappalli, in Cr.M.P.No.18 of 2021, dated 07.01.2021, with certain conditions. Having released from the prison, the petitioner failed to comply with the conditions imposed on him, but has filed an application before this Court in Crl.OP(MD) No.8688 of 2021 seeking modification. This Court, by order dated 02.07.2021, dismissed the petition, however, liberty was granted to the petitioner to approach the Sessions Court. Accordingly, he moved an application before the Principal Sessions Court, Tiruchirappalli, in Cr.M.P.No.2477 of 2021 and the learned Judge, by order dated 20.07.2021, modified the condition and directed the petitioner to report before the respondent police daily from 22.07.2021.

In order to relax this condition, the petitioner moved another application in Cr.M.P.No.2942 of 2021 and the learned Principal Sessions Judge, Tiruchirappalli, by order dated 09.08.2021, dismissed the same, https://hcservices.ecourts.gov.

CRL OP(MD)No.12687 of 2021 stating that the petition is premature and that the petitioner has complied the condition only for 13 days.

2.Now, the petitioner has filed the present criminal original petition seeking to relax the condition imposed by the learned Principal Sessions Judge, Tiruchirappalli, in Cr.M.P.No.2477 of 2021, dated 20.07.2021, stating that the petitioner is complying with the condition for the past 41 days.

3.Learned Government Advocate (Crl. Side), on instructions, submitted that the petitioner is complying with the condition from 28.07.2021 to 06.09.2021.

4.Since the petitioner is complying with the condition imposed on him regularly, the condition is fully relaxed and the criminal original petition stands ordered accordingly.
