PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records relating to CC.No.753 of 2025 on the file of Judicial Magistrate-II,Usilampatti dt.17.10.2025 and Quash the same as illegal in so far as the Petitioner alone and pass such further or other orders as this Honourable Court.

ORDER

The present petition has been filed by Accused No.3 in C.C. No.753 of 2025 on the file of the learned Judicial Magistrate No.II, Usilampatti, seeking to quash the charge sheet, wherein he is charged with offences under Sections 191(2), 191(3), 126(2), 296(b), 115(2), 118(1), and 351(3) of the BNS.

A perusal of the charge sheet reveals that the petitioner, along with the other accused, is alleged to have abused the defacto complainant and attacked him with a sickle; the present petitioner is also alleged to have attacked the defacto complainant with a wooden log, due to which the defacto complainant sustained simple injuries.

3. According to the learned Counsel appearing for the petitioner, the charge sheet is vague to the extent that it does not specifically point out the overtacts attributed to each of the accused persons. The petitioner is a stranger to the defacto complainant and, therefore, he has nothing to do with the occurrence.

4. Heard the learned Counsels appearing on either side and perused the materials available on record.

5. A perusal of the charge sheet clearly points out the specific overt act attributed to the petitioner.

6. In such circumstances, no legal grounds have been made out for quashing the charge sheet, and all the arguments raised by the petitioner are subject matter for trial. The trial Court is directed to dispose of the case without being influenced by any of the observations made by this Court. The personal appearance of the petitioner shall be dispensed with unless specifically directed by the trial Court.
