ORDER : The Court Made the following order :- The petitioner,who apprehends arrest at the hands of the respondent police for the offences punishable under Section 506(ii) I.P.C and Section 5(j)(ii) of Protection of Child from Sexual Offences Act, 2012 , in Crime No.5 of 2018, seeks anticipatory bail. 2.The case of the prosecution is that on 30.05.2018, the father of the victim lodged a complaint alleging that the first accused coerced her daughter and had sexual intercourse with her, as a result of that, the victim got pregnancy. Hence, the complaint. 3.
The learned counsel appearing for the petitioner would submit that the petitioner is an unnamed accused in the first information report. As per the statement recorded under Section 161(3) Cr.P.C, the petitioner is arraigned as Accused No.4. He further submitted that Accused Nos. 1 to 3 were already granted anticipatory bail by this Court. As per this petitioner is concerned, he only threatened the defacto complainant and he is the father-in-law of the A1. Hence, he prays for anticipatory bail to the petitioner.
4.The learned Additional Public Prosecutor appearing for the respondent submitted that totally there are four accused in this case. The petitioner is arraigned as Accused No.4 and the investigation is pending.
5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Mahila Court, Trichy District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Mahila Court concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioner shall appear before the concerned Mahila Court within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
