ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 143, 353, 341 I.P.C. and Section 3(1) of Tamil Nadu Public Property (Prevention of Damages and Loss) Act, 1992, in Crime No.136 of 2018, seek anticipatory bail.

2.The case of the prosecution is that the petitioners herein are auto drivers. On 03.08.2018 at about 11.00 a.m., the Authorities from the de facto complainant' Office came to the Auto stand and compelled the members of the Association to shift the auto stand to some other place for the reason that the Authorities are planned to construct a bus stop shed. Therefore, on 03.08.2018, the petitioners submitted a representation before the de facto complainant to shift the construction place of bus stop shed to some other place. But no action was initiated by the Authorities. Therefore, the petitioners and the other members of the Association conducted agitation and damaged the public properties. Hence the complaint.

3.It is submitted by the learned counsel appearing for the petitioners that the petitioners have filed W.P(MD).No.17986 of 2018 before this Court and the same is pending.

4.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. side) appearing for the respondent.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. The petitioners are directed to pay a sum of Rs.3,000/- (Rupees Three Thousand only) each to the credit of Crime No.136 of 2018, before the learned Judicial Magistrate, Rameswaram. Subject to this condition, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Rameswaram and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the learned Judicial Magistrate, Rameswaram, daily at 10.30 a.m.

for a period of two weeks from the date of receipt of a copy of this order and thereafter they shall appear on receipt of summon. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
