PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Certiorarified Mandamus, calling for the entire records, connected with the impugned Government Order passed by the first respondent in G.O.(1D)No. 218, School Education (Pa.Ka.5(1)) Department, dated 20.06.2019 and quash the same insofar as condition No.9(i) is concerned and consequently direct the respondents to permit the petitioner in the General Transfer Counseling for the year 2019 -20, scheduled to be held on 14.07.2019 or on other subsequent dates, for the vacancies to the post of Secondary Grade Teacher.

The petitioner was appointed as a Secondary Grade Teacher in Panchayat Union Middle School, Magalipatty, Thogaimalai Union, Karur. Her husband is working as Secondary Grade Teacher in Andipatty Union, Theni District and her son is with him. Since her husband and son are in Andipatty, she was 2/5
awaiting to participate in transfer counseling. While so, the Government has passed an order in G.O.(1D)No.218, School Education (Pa.Ka.5(1)) Department, dated 20.06.2019, wherein, it is stated that the teachers, who are willing to participate in the transfer counseling has to serve in the present post for a period of three years. Challenging the above Government order, the petitioner has filed this writ petition in the year 2019.
2.Today (07.11.2024), when this writ petition is taken up for hearing, the learned counsel on either side submits that as per the proceedings of the District Educational Officer, Thogaimalai in Na.Ka.No.574/A3/2022, dated 28.02.2022, the petitioner has now been transferred to Panchayat Union Middle School, Akkandimedu, Thogaimalai Union, Karur and therefore, she is not interested in prosecuting this writ petition.
3.Recording the submission made by the learned counsel on either side, this Writ Petition is closed. No Costs. Consequently, 3/5
