This Petition is filed to condone the delay of 288 days in preferring the above Civil Miscellaneous Appeal.

2.Heard the learned counsel for the Petitioner and respondents 1 and 2 and perused the materials placed before this Court. Though the name of the 3rd respondent printed in the cause list no one has appeared.

3. For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned.
