This writ petition is filed seeking a writ of Mandamus to direct the respondents to consider and pass appropriate orders on the petitioner's representation dated 17.12.2016 with regard to allotment of funds for acquisition and compensation for the lands comprised in Survey No.190 (0.1.13 hectares), Survey No.192 (0.0.42 hectares) and Survey No.193 (0.1.4 hectares) situated at Neelagiri Therkkuthottam Village, Thanjavur, Thanjavur District, within the time stipulated by this Court.
2.Mr.M.Alagathevan, learned Special Government Pleader, takes notice for the respondents.
3.By consent of both the parties, this writ petition is taken up for final hearing at the stage of admission itself. 4.Heard both sides.
5.The case of the petitioner is that since the respondents are using the lands owned by the petitioner comprised in Survey No.190 (0.1.13 hectares), Survey No.192 (0.0.42 hectares) and Survey No.193 (0.1.4 hectares) situated at Neelagiri Therkkuthottam Village, Thanjavur, Thanjavur District, he made a representation dated 17.12.2016, to the respondents, seeking to allot funds for acquisition and also pay compensation for the same. Since the same has not been considered so far, the petitioner is before this Court. 6.The learned counsel for the petitioner would submit that it would be suffice, if the representation of the petitioner dated 17.12.2016, is disposed of by the respondents as per law. 7.
Considering the limited scope of the relief sought for, this Court, without going into the merits of the petitioner's claim, directs the respondents to consider the representation of the petitioner, dated 17.12.2016, and pass appropriate orders on its own merit and in accordance with law, after affording due opportunity of hearing to the petitioner as well as other interested parties, if any, within a period of six weeks from the date of receipt of a copy of this order.
