Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 506(i) IPC and Section 4 of T amil Nadu Prohibition of Harassment of Women Act, 2002, in Crime No.68 of 2018, seeks anticipatory bail.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent Police.

3. The petitioner had hit the victim on the head. The learned counsel for the petitioner undertakes that the petitioner would pay a sum of Rs.10,000 to the victim and prays for anticipatory bail.

4. The said amount can be deposited in the crime number in question and the defacto complainant can withdraw the same or the petitioner can take Demand Draft and hand over the same to the local police station, from whom the defacto complainant can be collected the same. The mode is left to the petitioner. It would be a nonrefundable payment.

5. Subject to the above said condition, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, https://hcservices.ecourts.gov.in/hcservices/

Sattur, Virudhunagar District, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
