ORDER : The Court made the following order :- The petitioner/ Accused No.1, who was arrested and remanded to judicial 1/4

custody on 25.01.2025 for the offence punishable under Sections 3 r/w 4 and Section 5(g) r/w. 6 of Protection of Child from Sexual offences Act, 2012, in Spl.S.C.No.30 of 2025 in Crime No.3 of 2025 on the file of the learned Fast Track Court (Mahalier Neethimandrum), Ramanathapuram, seeks bail,

2. The case of the prosecution is that on 24.01.2025, the defacto complainant was going to natural call at night hours, the petitioner along with other accused persons have sexually assaulted the victim girl. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner and the victim girl were in love with each other, which was not accepted by the family members of the victim girl. He further submitted that co-accused /A2 had already been granted bail by this Court in Crl.OP(MD).No.8196 of 2025 dated 30.04.2025. He further submitted that the petitioner is in judicial custody from 25.01.2025. Hence, he seeks bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the 2/4

investigation has been completed and the charge sheet has also been filed. He further submitted that if the petitioner is enlarged on bail, he may abscond, thereby causing delay in the trial proceedings and may also cause threat to the victim girl, her family members and witnesses. He further submitted that the statement under section 164 has been recorded from the victim girl. Hence, he opposed for grant of bail to the petitioner.

5. The learned counsel for the Intervenor submitted that the petitioner along with other accused persons have sexually assaulted the victim girl, who is aged about 16 years. Further, he submitted that the petitioner had committed serious offence and he prays for dismissal of this Criminal Original Petition.

6. Considering the facts and circumstances of the case and also the fact that nature of the offence committed by the petitioner, the victim girl is aged about 16 years. Further, the petitioner has committed serious offence and the custodial interrogation is necessary. Further, if the petitioner is released on bail, he may tampering the witnesses and abscond. Further, considering the gravity of the offence committed by the petitioner and also considering the strong objection raised by the prosecutor as well as the learned counsel for the intervenor, this Court is not 3/4

inclined to grant bail to the petitioner.
