PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to direct the Honble Additional District and Sessions Judge, Special Court for E.C. Act Cases, Pudukottai to take on file the petition filed by the petitioner on 02.04.2026 under section 230 of BNSS, which was returned at the threshold without being numbered, to appropriate orders on merits in accordance with law.

ORDER
The present petition has been filed seeking a direction to the learned Additional District and Sessions Judge, Special Court for E.C. Act Cases, Pudukottai to take on file the petition filed by the petitioner on 02.04.2026 under Section 230 of BNSS, which was returned.
2. A perusal of the records shows that the petitioner is arrayed as the second accused in C.C. No.157 of 2025. The petitioner has filed an application under Section 230 of the BNSS seeking a direction to the investigating agency to furnish the documents enclosed along with the charge sheet in the said case.
3. The said application was returned by the trial court on the ground that all the documents referred in the final report had already been furnished to the petitioner and, therefore, the application was not maintainable. Challenging the same, the present petition has been filed.

4. The learned Counsel appearing for the respondent submitted that, so far, they have not received the call detail records (CDR), banking details, and travel history from the respective institutions. As and when these documents are received, they will file an appropriate application before the trial Court seeking permission for production of additional documents at that stage. In the event the Court admits those documents, the copies will be furnished to the petitioner.
5. In view of the clarification submitted by the respondent herein, no further orders are called for in the present petition. Accordingly, this Criminal Original Petition is closed.
