..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 2 and 3 to issue the patta to the Petitioners with regard to the properties in Karuppur Padugai Village Survey No.s.5/2 measuring an extent of 0.06.5 hectares, S.No.6/1 to an extent of 0.32.0 hectares, S.No.7/2, to an extent of 0.01.0 hectares, S.No.15/1 to an extent of 0.38.0 hectares, S.No.14 to an extent of 0.14.5 hectares, S.No.15/3 to an extent of 0.08.0 hectares, S.No.17/4, to an extent of 0.23.0 hectares and S.No.13/1 to an extent of 0.18.0 hectares. ORDER

Heard both sides.

2.By consent of both sides, the main Writ Petition itself is taken up for final disposal.

3.The grievance of the Petitioners is that they submitted a petition before the First Respondent/The District Collector, Thanjavur District, Thanjavur on the ''Grievance Day'' seeking issuance of ryotwari patta. Also, for the said petition, acknowledgement, dated 19.9.2005 was issued by the First Respondent/District Collector's Office. It is quite evident that the said representation of the Petitioners dated 19.9.2005 has not seen the light of the day and no orders appears to have been passed on the petition/representation made by the Petitioners.

4.In view of the fact that the Petitioners representation, dated 19.9.2005 is pending and till date, not yet disposed of, at this stage, this Court considering the long lapse of time from the date of presentation of petition/representation dated 19.9.2005, in the interest of justice and fair play, directs the Petitioners to submit a fresh representation in the subject-matter in issue within a period of two weeks from the date of receipt of a copy of this order.

The said fresh representation is to be submitted by the Petitioner before the Third Respondent/The Tahsildar, papanasam Taluk Office, Papanasam, Thanjavur District and on receipt of the said fresh representation, the Third Respondent is to look into the same and to pass appropriate orders on merits in a dispassionate manner within a period of four weeks from the date of receipt of such fresh representation from the Petitioner. It is open to the Third Respondent/The Tahsildar, papanasam Taluk Office, Papanasam, Thanjavur District to call for any relevant records/documents from the Petitioners, who in that event shall submit the same to the Third Respondent to enable him to dispose of his fresh representation in a complete and comprehensive manner.

The Petitioner is directed to cooperate with the Third Respondent in regard to the disposal of the fresh representation within the time limit determined by this Court.

5.With the aforesaid observations and directions, the Writ Petition stands disposed of. No costs.
