ORDER

This writ petition has been filed for a writ of Mandamus to direct the respondents and its officials not to interfere in any manner with the petitioner street vending business of selling readymade children's clothes and handlooms at Vadakku Radha Veedhi near Ram Raj Store, Tirunelveli, by considering the petitioner's representation dated 10.05.2023.

2. Although the third respondent was impleaded pursuant to the order passed by this Court dated 07.07.2023, there is no representation on behalf of the third respondent.

3. The learned counsel for the petitioner submits that the petitioner has been issued with an ID card as a street vendor by the office of the first 2/5

respondent. However till date, Town Vending Committee has not been constituted and the Street Vending Zone have also not been identified.

4. The learned counsel for the petitioner drawn attention to the order passed by this Court in W.P(MD)No.327 of 2018 on 05.03.2018 in the case of S.Velmurugan Vs. The Commissioner, Tirunelveli and others, wherein, prayer was made seeking a direction to the respondents not to disturb the petitioner's street vending business located at North Car Street, Tirunelveli city except due process of law.

Since the facts of the present case are similar to the one discussed in the aforesaid of this Court, dated 05.03.2015, there shall be a direction to the respondents not to disturb the petitioner pending constitution of the street vending committee and the identification of the street vending Zone 6.The first respondent shall endeavour to ensure the committee constituted as expeditiously as possible. Pending such exercise, the petitioner shall not be disturbed.

7. The writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
