District and demark the properties by considering the representation of the petitioner dated 02.05.2023 within a time frame as fixed by this Court.

ORDER

The petitioner herein seeks a direction to the respondents to survey the property situated in Survey No.82/2A and 76/6 in Aavichipatti Village, Natham Taluk, Dindigul District, by considering his representation dated 02.05.2023.

2.Heard the arguments of Mr.S.Karthikeyan, learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate appearing for the respondents.

3.The petitioner claims right over the subject property under a gift

deed executed by the petitioner's mother, Lakshmi Ammal dated 21.12.2001. The patta for the subject property stands in the name of the petitioner and his mother. The petitioner submitted an application on 30.04.2023 seeking survey of the subject property and the same has not been considered. Hence, the petitioner has come before this Court. 4.The learned Government Advocate appearing for the respondents would submit that the revenue records stand in the name of the petitioner and his mother, Lakshmi Ammal. Therefore, the request of the petitioner can be considered only after hearing the legal heirs of Lakshmi Ammal. He would further submit that the petitioner has failed to produce the acknowledgment for having submitted an online application.

5.In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to produce the acknowledgment for having submitted an online application before the first respondent within a period of two weeks from the date of receipt of a copy of this order. On production of acknowledgment, the first respondent shall consider the online application of the petitioner and pass final orders on its own merits within a further period of twelve weeks,

after issuing notice to the petitioner and the legal representatives of Lakshmi Ammal. The petitioner shall also submit the details of the legal heirs of Lakshmi Ammal before the first respondent within a period two weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. No costs.
