ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under section 194 of BNSS altered into Section 108 of BNS, 2023 & Section 4 of Tamilnadu Prohibition of Charging Exorbitant Interests Act, 2003 in Crime No.708 of 2024 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the Defacto-complainant's father Nagarajan, was running old iron scrap business. He borrowed money from several money lenders for the development of his business. Due to financial crisis, the said Nagarajan was not able to repay the said debt amount in time. This petitioner and other money lenders went to the house of the said Nagarajan and asked about repayment of the debt amount. Unable to withstand the pressure, on 26.09.2024, he committed suicide by hanging and found dead in his house. Hence, a case has been registered.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he had not committed any offence as alleged by the prosecution. A false case has been foisted against the petitioner. This petitioner is ready and willing to abide any conditions that may be imposed by this Hon'ble 2/5
Court. Hence, he seeks anticipatory bail.
4. The learned Government Advocate (Crl side) would submit that the Defacto-complainant's father borrowed amount to this petitioner and other money lender as debt for improve his iron scrap business. Due to financial crisis, he was not able to repay the debt amount. On 26.09.2024, he committed suicide by hanging and died in his house. The petitioner lending money with exorbitant interest rate, and hence he objected to grant anticipatory bail to the petitioner. However, he fairly concedes that no previous case is pending against the petitioner.
5. Taking into consideration of the facts and circumstances of the case and also the fact that no previous case is pending against the petitioner, this court is inclined to grant anticipatory bail to the petitioner, with certain conditions:

Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate No.I, Sivagangai on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that: 3/5
(a) the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders;
(c) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioner shall not abscond either during investigation or trial; (e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and; (f)if the accused/petitioner thereafter absconds, a fresh FIR can be registered under Section 269 of BNS, 2023.
