DECREE:- This Civil Miscellaneous Appeal having come up for final hearing on this date, upon perusing the grounds of Appeal, the order of the Tribunal and the material papers to the Appeal and upon hearing the arguments of Mr.P.M.Vishnuvarathanan, Advocate for the Appeallant and of Mr.M.Jerin Mathew, Advocate for the respondents and this Court doth order and decree as follows:-

(1) That the award passed by the Motor Accident Claims Tribunal/ Special District Judge, Trichy, dated 24/03/2021 made in MCOP.No.866/2016 be and hereby is enhanced from Rs.6,01,000/- to Rs. 7,72,000/- (Rupees Seven Lakhs Seventy two Thousand Rupees only ) and the Civil Miscellaneous Appeal is dismissed.

(2) That the Appellant/Transport Corporation be and hereby is directed to deposit the Compensation amount awarded i.e.,Rs.7,72,000/ less the amount already deposited together with interest at the rate of 7.5% per annum from the date of claim petition till the date of deposit to the credit of MCOP. No. 866 of 2016 on the file of the the Motor Accident Claims Tribunal/ Special District Judge, Trichy, Within a period of six weeks from date of receipt of a copy the judgement herein;

(3) That on such deposit being made, the respondent herein/Claimant be and hereby is entitled to withdraw the same as per the order passed by the Tribunal, by filing necessary application before the Tribunal.

4) That the ratio of apportionment made by the Tribunal shall be kept intact.
