This writ petition has been filed, seeking a direction to the respondent to conduct enquiry in respect of the appeal dated 04.07.2017 made by the petitioner for issuance of patta to petitioner's property situated over an extent of 18 1⁄2 cents in Survey No.1092, Thirukkurungkudi Village, Nanguneri Taluk, Tirunelveli District with house bearing Tax Assessment No.3015 and Door No.13/6 laying with South Avaranthalai west street, Thirukkurungkudi Part-I after affording due opportunity to the petitioner.
2. Mr.M.Alagathevan, learned Special Government Pleader takes notice for the respondent. By consent, the writ petition itself is taken up for final disposal at the admission stage itself. https://hcservices.ecourts.gov.in/hcservices/
3. The case of the petitioner is that he has filed an
appeal on 04.07.2017 to the respondent, aggrieved by the order of the Tahsildar, rejecting the claim of the petitioner in respect of issuance of patta. Since no enquiry has been conducted on the appeal and the same has been kept pending without any progress, the petitioner is before this Court seeking above direction.
4. The learned Special Government Pleader appearing for the respondent would submit that if a reasonable time is granted to the respondent, the appeal filed by the petitioner will be considered and suitable orders passed in a time bound manner.
5. In view of the above submission, this Court, without going into the merits of the matter, directs the respondent to consider the appeal filed by the petitioner dated 04.07.2017 and pass necessary orders thereon on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and other interested parties, if any.
6. With the above direction, this petition is disposed of. No costs.
