PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the impugned second penal list as on 01.01.2019 published by the respondents relating to the post of BT Assistant (Mathematics), Middle School, Gandarvakottai Union, Pudukottai District and to quash the same and consequently, directing the respondents to include the name of the petitioner in the penal list as on 01.01.2019.

ORDER

This Writ Petition has been filed to quash the impugned second penal list dated 01.01.2019 published by the respondents relating to the post of B.T. Assistant (Mathematics), Middle School, Gandarvakottai Union, Pudukottai District and to direct the respondents to include the name of the petitioner in the penal list as on 01.01.2019.

https://hcservices.ecourts.gov.in/hcservices/ 2.Though the learned counsel for the petitioner would submit that the impugned second penal list, dated 01.01.2019, published by

the respondents, is arbitrary and illegal, he seeks liberty to make representation before the respondents for including the petitioner's name in the impugned panel list. He further seeks indulgence of this Court for a direction to the respondents to keep one post as vacant, till the disposal of the petitioner's representation.

3.In reply, the learned Special Government Pleader appearing for the respondents would submit that if the petitioner made a representation on or before 10.07.2019, the concerned authority shall consider the same on merits and in accordance with law. 4.By considering the request made by both sides, this Writ petition is disposed of with liberty to the petitioner to make a representation on or before 10.07.2019 to the respondents seeking his remedy and on receipt of such representation, the respondents are directed to consider the same within a period of one week. If no action is being taken on receipt of such representation within the stipulated time, the respondents are directed to keep one post as vacant. No costs. Consequently, connected miscellaneous petitions are closed.
