PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondent to settle the petitioner's surrender leave salary for 90 days in respect of the year 2011-2012, 2012-2013, 2013-2014, 2014-2015, 2015-2016, 2016-2017, 2017-2018 and 2018-2019 together with interest at the rate of 18% per annum payable from the date for retirement to till the date of actual payment.

ORDER

This writ petition is filed to direct the respondent to settle the petitioner's surrender leave salary for 90 days in respect of the year 2011-2012, 2012-2013, 2013-2014, 2014-2015, 2015-2016, 2016-2017, 2017-2018 and 2018-2019 together with interest at the rate of 18% per annum payable from the date for retirement to till the date of actual payment.

2.By consent of both parties, the writ petition is taken up for final disposal at the stage of admission itself. 3.The grievance of the petitioner is that with the relief sought for in the prayer, though he has made a representation, dated 10.02.2020, before the respondent, so far no action has been taken. Hence, the present writ petition.

4.Mr.P.M.Vishnuvarthan, learned standing counsel appearing for the respondent would fairly submit that petitioner's surrender leave salary for 90 days in respect of the years 2011-2012, 2012-2013, 2013-2014, 2014-2015, 2015-2016, 2016-2017, 2017-2018 and 2018-2019, https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.15239 of 2020 will be disbursed to the petitioner, if he is entitled for the same. He would further submit that the petitioner's representation dated 10.02.2020, will be disposed of by the respondent on merits and in accordance with law, within a period of eight weeks. 5.Recording the submission made by the learned standing counsel appearing for the respondent, this Court directs the respondent to consider the petitioner's representation dated 10.02.2020 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order;

6.With the above direction, the Writ Petition stands disposed of. No costs.
