PRAYER: Criminal Original Petition is filed under Section 528 of BNSS 2023, to direct the respondent Nos.1 and 2 to give police protection for fencing the petitioner's property and to the life and limb of the petitioner and her family by considering her representation dated 02.04.2026 within the period which may be stipulated by this Court.

ORDER

The present petition has been filed seeking a direction to the second respondent police to provide police protection for the purpose of fencing the petitioner's property.

2.The petitioner herein, who is the plaintiff, has filed a suit in O.S.No.133 of 2004 before the Sub Court, Periyakulam, seeking decree for specific performance. The said suit was decreed by the trial Court on 10.03.2008. Consequently, a sale deed has been executed by the Court in favour of the petitioner on 23.02.2010.

3.The petitioner has also mutated the revenue records in his favour in patta No.1428. The respondent Nos.3 and 4 herein had filed a suit in O.S.No.97 of 2021 before the District Munsif Court, Andipatti seeking permanent injunction of the above said property. The said suit was dismissed on 09.10.2025. Thereafter, the petitioner had approached the police officials 2/5

seeking permission for fencing the property.

4.The leaned counsel for the petitioner brings to the notice of this Court that the petitioner had filed a writ petition in W.P.(MD).No.2281 of 2025 seeking mandamus, directing the respondents to survey the petitioner's land. The said writ petition was allowed on 28.01.2025. 5.In view of the above said facts, there shall be a direction to the second respondent police to provide appropriate police protection to the petitioner for fencing the property.

6.In view of the above observations, this Criminal Originan Petition stands disposed of.
